Welcome to Camdid!
We know these Terms are boring, but they are important – so please read them!
We've tried not to use too much legal jargon so that you can understand what we're saying. If there's anything you do not understand, please let us know at jakub.lunarzewski@camdid.app before you start using Camdid.
By using Camdid, you agree to these Terms.
1. Who's who??
When we say "Camdid", "us", "our" or "we" in these Terms we are referring to the team that develops and maintains the app.
When we say "you" or "your" in these Terms we are referring to each person who uses Camdid (whether you are happily snapping and uploading photos to our app or just lurking in the background).
2. Why are words randomly capitalised in these Terms?? (AKA - Definitions)
If you see a capitalised word in these Terms, it has the meaning given below:
Confidential Information includes information that is by its nature confidential, is designated as confidential or a reasonable person knows or ought reasonably to know is confidential. Confidential Information does not include information which is or becomes generally known to the public other than through a breach of this agreement or the law.
Content means anything you upload to Camdid including photos, videos, comments, event descriptions and details, Personal Information and other Intellectual Property or data inputted by you to Camdid.
Dodgy Events means gatherings that are illegal or gatherings which promote illegal activity.
Inappropriate Content is anything you'd be embarrassed for your mum to see. Specifically, Inappropriate Content means content depicting, promoting, engaging in, coordinating or referencing: violence and incitement; crime; dangerous or criminal organisations or individuals; fraud, scams and deceptive practices; adult sexual exploitation; bullying and harassment; child sexual exploitation, abuse and nudity; human exploitation; suicide, self-harm and eating disorders; adult nudity and sexual activity; adult sexual solicitation and sexually explicit language; hateful conduct; privacy violations; violence and graphic content; misinformation; spam; and illegal activity.
Intellectual Property means any copyright, registered and unregistered trade marks, designs (whether or not registered or registrable), domain names, know-how, inventions, processes, trade secrets or Confidential Information; software, computer programs, databases or source codes, including any application, or right to apply, for registration of, and any improvements, enhancements or modifications of, the foregoing.
IP Rights means for the duration of the rights in any part of the world, any industrial or intellectual property rights, whether registrable or not, including in respect of Intellectual Property.
Personal Information has the meaning given to that term in the Privacy Act 1988 (Cth).
Privacy Policy means Camdid's privacy policy which is available here.
Terms means these terms of use.
Users means any person who uses Camdid (whether you have made an account on Camdid or not).
3. Some Don'ts
You agree that you will not:
- Be a dickhead – you agree that cannot not bully, harass, belittle attempt to (or actually) scam or do anything along those lines to other Users.
- Be gross – you agree that you cannot publish Inappropriate Content on Camdid or direct Users to Inappropriate Content on other platforms.
- Be a criminal – you agree that you cannot do anything illegal, misleading or fraudulent.
- Look for loopholes – you agree that, in the wise words of The Castle, these Terms are "the vibe". You agree that you cannot violate these Terms or do anything contrary to the spirit of them. You also agree that you will not help or encourage anyone else to violate these Terms.
- Impersonate others – you agree that you cannot impersonate someone or something you aren't, and you can't create an account for someone else unless you have their express permission. To be clear – you don't need to use your real name on Camdid, but you can't pretend to be some other real person.
- Promote Dodgy Events – you agree that you will not promote, invite people to attend or share photos or information from or about Dodgy Events.
- Be a hacker – you agree that you cannot: undermine the security or integrity of our computing systems or networks; use Camdid in a way that might impair functionality or interfere with other Users' experience of Camdid; decompile, reverse engineer, disassemble, or sublicence anything on Camdid; copy, distribute, modify or make derivative works of any of Camdid's content or use any of Camdid's IP Rights in a way not expressly permitted by us in writing; download, collect, reproduce or steal other User's data (without their express permission); or introduce or upload anything to Camdid that includes viruses, malicious code or the like.
4. Promises you make
You agree that you will:
- Respect people's privacy – you agree that you will not post someone else's private or Confidential Information without their permission or do anything that violates someone else's rights, including IP Rights (e.g., copyright infringement, trademark infringement, counterfeit, or pirated goods).
- Let us display your Content - You agree to grant us a licence (this is a legal word that kind of means "permission") to use your Content. This does not change your rights in your Content. We do not claim ownership of your Content that you post on or through Camdid and you are free to share your Content with other people or on other platforms, wherever and whenever you want. When you share, post, or upload Content that is covered by IP Rights (like photos or videos) on or in connection with Camdid, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide licence to host, use, distribute, modify, run, copy, display, translate, and create derivative works of your Content. This licence will end when your Content is deleted from our systems. You can delete Content individually or all at once by deleting your account. To learn more about how we use information, and how to control or delete your Content, refer to our Privacy Policy.
- Let us turn your visions to life – we welcome new ideas and feedback on ways to improve Camdid. If you provide ideas or feedback to us, you agree that we may use those ideas or feedback in any manner which we see fit (including to develop new features) and no benefit will be due to you as a result of any use by us of any ideas or feedback.
- Accept the consequences of your actions – if you do anything which breaches these Terms (for example, if you upload Inappropriate Content) you agree that we may delete your Content and/or your account without notice to you. You also agree that we may provide details of the breach to law enforcement agencies if we (acting reasonably) deem it appropriate to do so.
- Have read our Privacy Policy – sorry, this is another boring document. But by using Camdid you agree that you have read and agree to our Privacy Policy.
- Be patient with us – as Hannah Montana told us, Nobody's Perfect. We will use reasonable skill and care in providing Camdid to you and in keeping a safe, secure, and error-free environment, but we cannot guarantee that Camdid will always function without disruptions, delays, or imperfections.
5. Promises we make
We agree to:
- Fix bugs etc – we may, from time to time and at our discretion repair, modify, add to and upgrade Camdid or any part of it and perform system maintenance on Camdid, or any part of it, including to schedule periods during which Camdid will not be available for such system maintenance. We will endeavour, to the extent reasonably practical, to schedule maintenance to minimise disruption to Users.
6. What happens to my Content from a data security perspective?
We will always do our best to protect your Content. The steps we take to protect your Content are explained in our Privacy Policy. Our Privacy Policy also explains the rights you have in relation to your Content and what you can ask us to do (or not do) with it.
7. I've got beef with you – what do I do now?
You must not commence court proceedings relating to any dispute, controversy or claim arising from, or in connection with these Terms (Dispute) without first writing to us about the Dispute (Dispute Notice) at jakub.lunarzewski@camdid.app.
If you and us cannot agree how to resolve the Dispute within 80 Business Days of receipt of the Dispute Notice, we may refer the matter to a mediator.
8. Is Camdid liable if something goes wrong?
To the fullest extent possible under law, nah, we're not.
You acknowledge that we live in a big, bad world where bad things happen. People try to hack shit. It's wild out there. While we will do our very best to protect your Content (including by complying with all applicable laws), you acknowledge that we are not liable to you if your Content is stolen, misused or if you suffer loss in any way in connection with your use of Camdid.
Specifically, provided that we have acted with reasonable skill and care, we do not accept responsibility for:
- losses not caused by our breach of these Terms or otherwise by our acts;
- losses that are not reasonably foreseeable by you and us at the time of entering into these Terms;
- any Inappropriate Content posted by others that you may encounter on Camdid;
- the actions or conduct of others (whether online or offline); and
- events beyond our reasonable control.
The extra, extra boring bits
- Jurisdiction – these Terms are governed by the laws of New South Wales, Australia. You (and us) irrevocably and unconditionally submit to the exclusive jurisdiction of the courts operating in New South Wales, Australia and any courts entitled to hear appears from those courts and waive any right to object to proceedings being brought in those courts.
- Severance (the legal kind, not the TV show kind) – if a provision of these Terms is held to be void, invalid, illegal or unenforceable, that provision is to be read down as narrowly as necessary to allow it to be valid or enforceable, failing which, that provision (or that part of that provision) will be severed from these Terms without affecting the validity or enforceability of the remainder of that provision or the other provisions.
- Survivor (again, the legal kind, not the TV show kind) – clauses 7 and 8 survive the termination of this agreement. This agreement terminates when your account is deleted or, if you don't have an account, when you stop using Camdid.
- Changes to these Terms – we might need to change these Terms from time to time. If we do, we will notify you (for example, by notifying you in the app) before we make changes to these Terms and give you an opportunity to review them before they go into effect. Then, if you continue to access or use Camdid, you will be bound by the updated Terms. If you do not agree to any updated Terms or wish to terminate your agreement to this contract, you can do so by deleting your account and no longer accessing or using any part of Camdid.
